Vasilko & Pedersen PLLC is pleased to announce Partner and founding Attorney of Vasilko & Pedersen PLLC, Shawna D. Vasilko’s recent success in front of the North Carolina Cout of Appeals. This achievement showcases the determination and care that Attorney Vasilko brings to each case.
The January 16, 2024, published decision in Maness v. Kornegay and McNair(COA23-301) highlights how Attorney Vasilko fought for her client. Attorney Vasilko did not stop when the district court made a contradictory ruling in awarding a third-party non-familial individual custodial rights to a minor child, along with granting her client, the biological father, custodial rights as well. Attorney Vasilko knew the law and believed that her client had not acted inconsistent with his parental rights and that a best interest analysis between a third party and a biological parent was not appropriate. Attorney Vasilko’s argument reversed the district court’s decision and forced another hearing for the district court to use the appropriate standard and recognize the client’s constitutionally protected parental rights. Attorney Vasilko will go on to represent her client in district court now under the correct standard.
Not only has Attorney Vasilko shown her tenacity for her client but will continue to prove valuable for all other individuals who find themselves in a similar situation.
